Rubbish Collection Chiswick Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Collection Chiswick provides waste and rubbish collection services to domestic and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business or organisation that requests and pays for the waste collection service.

Company means Rubbish Collection Chiswick, the provider of rubbish collection and related services.

Services means any rubbish, junk, waste removal, recycling, or related service supplied by the Company to the Customer.

Waste means any materials, items or substances to be removed by the Company, as described at the time of booking.

Booking means any confirmed request by the Customer for Services, whether made by telephone, email, online form or in writing.

2. Scope of Services

The Company provides waste and rubbish collection services including, but not limited to, household rubbish removal, office clearance, bulky waste removal, garden waste removal and general non-hazardous waste collection. The precise scope of the Services will be agreed at the time of booking.

The Company reserves the right to decline any job or remove any specific item at its sole discretion, particularly where health and safety, access, or legal constraints apply.

3. Booking Process

3.1 Bookings may be made by telephone, email or through an online booking system where available. The Customer must provide accurate information about the nature and volume of the waste, access conditions, property type and any parking or loading limitations.

3.2 A booking is considered provisional until confirmed by the Company. Confirmation may be delivered verbally, by email, text message or booking confirmation document. Only once confirmed will a binding contract arise between the Customer and the Company.

3.3 The Company may request photographs or a written description of the waste prior to confirming a booking. This is to assist in estimating the volume, weight and type of waste, and in allocating appropriate vehicles and staff.

3.4 Any estimates, including price estimates based on volume, are provided in good faith but are subject to revision on site if the actual waste volume, type, or access conditions differ from the information provided at the time of booking.

4. Access and Customer Obligations

4.1 The Customer must ensure that the Company and its personnel have safe and reasonable access to the waste. This includes providing accurate instructions, arranging necessary permissions, and making sure that entrances, corridors, lifts and stairways are unobstructed.

4.2 Where parking restrictions apply, the Customer is responsible for arranging temporary permits or ensuring suitable parking is available. Any parking charges, fines or penalties incurred as a result of the Customer’s failure to provide suitable parking will be added to the Customer’s invoice.

4.3 The Customer must ensure that the waste is not contaminated with hazardous materials, unless expressly agreed in advance. If the Company discovers hazardous or prohibited items, it may refuse to remove them or adjust the price to cover additional handling and disposal costs.

4.4 The Customer confirms that it is the owner of the waste or has the authority of the owner to request its removal.

5. Pricing and Payment

5.1 Prices are generally based on the volume, type and weight of the waste, as well as the time required for loading and any particular access issues. The Company may provide a price guide prior to arrival, which is subject to confirmation once the waste has been inspected in person.

5.2 Unless otherwise agreed, payment is due immediately upon completion of the Services. The Company may request full or partial payment in advance, particularly for larger clearances or commercial contracts.

5.3 Payment may be made by cash, debit card, credit card, bank transfer or other methods as advised by the Company. For card payments, the Customer authorises the Company to take payment for the agreed charges once the Services are completed or as otherwise agreed.

5.4 All prices quoted are exclusive of VAT unless stated otherwise. Where VAT is chargeable, it will be added to the invoice at the applicable rate.

5.5 If the Customer fails to make payment on the due date, the Company reserves the right to charge interest on the overdue amount at the statutory rate allowable in the United Kingdom, together with all reasonable costs of recovery.

6. Cancellations and Amendments

6.1 The Customer may cancel a booking by giving at least 24 hours notice prior to the agreed arrival time. Cancellations must be communicated directly to the Company by telephone or email.

6.2 Where less than 24 hours notice is given, the Company may charge a cancellation fee to cover administrative costs and loss of opportunity. The level of the fee will be reasonable and proportionate to the booking.

6.3 If the Customer is not present or cannot be contacted at the agreed time, or if access cannot be gained due to circumstances within the Customer’s control, the Company may treat the situation as a late cancellation and charge a call-out or cancellation fee.

6.4 If the Customer wishes to amend the booking, such as changing the date, time or scope of the Services, the Company will use reasonable endeavours to accommodate the request, but cannot guarantee availability. Any changes may affect the price.

6.5 The Company reserves the right to cancel or reschedule a booking due to vehicle breakdown, staff illness, severe weather, safety concerns, or other events beyond its reasonable control. In such circumstances, the Company will inform the Customer as soon as is practical and offer an alternative appointment. The Company will not be liable for any indirect losses arising from such changes.

7. Waste Types and Regulations

7.1 The Company operates in accordance with applicable UK waste management legislation and environmental regulations. Waste collected will be transported and disposed of at authorised facilities, with an emphasis on recycling and responsible disposal where possible.

7.2 The Company will not collect certain types of waste unless previously agreed, including but not limited to asbestos, clinical or medical waste, toxic chemicals, solvents, gas cylinders, explosives, radioactive materials or other hazardous substances as defined by relevant regulations.

7.3 If prohibited or hazardous items are discovered within the waste without prior disclosure, the Company may refuse to remove them, apply an additional charge, or terminate the Services. The Customer will remain responsible for such items.

7.4 The Customer is responsible for describing the waste accurately. The Company may request a waste transfer note or provide one where required by law. The Customer must retain copies of such documents as required under relevant waste regulations.

8. Performance of Services

8.1 The Company will carry out the Services with reasonable care and skill, using appropriately trained personnel and suitable vehicles or equipment.

8.2 All collection times and dates are estimates only, and while the Company aims to arrive within agreed time windows, it cannot guarantee precise arrival times. The Customer should allow reasonable flexibility for traffic and operational delays.

8.3 If the Company reasonably considers that completing the Services would pose a risk to health and safety, property, or public welfare, it may suspend or refuse to carry out some or all of the Services. The Customer may be offered an alternative solution where feasible.

9. Liability and Limitations

9.1 Nothing in these Terms and Conditions limits or excludes the Company’s liability for death or personal injury caused by its negligence, for fraud, or for any other matter that cannot be excluded or limited under UK law.

9.2 Subject to the above, the Company’s total liability to the Customer in respect of any single incident or series of related incidents shall not exceed the total price paid or payable for the specific Services giving rise to the claim.

9.3 The Company will not be liable for any loss of profit, loss of business, loss of opportunity, or any indirect or consequential loss arising out of or in connection with the Services.

9.4 The Customer is responsible for removing or securing any valuable or fragile items prior to the commencement of the Services. While the Company will take reasonable care when loading and removing waste, it will not be liable for damage to items that the Customer has left within piles of waste or in areas where the waste is located, unless caused by the Company’s negligence.

9.5 The Customer must notify the Company in writing of any alleged damage or loss within 48 hours of completion of the Services, providing reasonable evidence and details. Failure to do so within this timeframe may affect the Company’s ability to investigate and accept responsibility.

10. Customer Indemnity

The Customer agrees to indemnify and keep indemnified the Company from and against any claims, costs, damages, losses or expenses arising from:

a) The Customer’s breach of these Terms and Conditions.

b) The Customer’s failure to disclose the presence of hazardous or prohibited materials.

c) Any claim by a third party that the Customer did not have lawful authority to dispose of the waste.

11. Complaints and Disputes

11.1 If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, providing full details of the issue.

11.2 The Company will investigate complaints in a fair and timely manner, seeking to reach a reasonable resolution with the Customer. This may include offering a partial refund, a price adjustment, or a return visit where appropriate.

11.3 If a dispute cannot be resolved directly, the parties may consider using mediation or another form of alternative dispute resolution before commencing court proceedings.

12. Data Protection and Privacy

12.1 The Company may collect and process personal data about the Customer, including contact details, address, and payment information, for the purposes of providing the Services, administering bookings and handling accounts.

12.2 The Company will handle personal data in accordance with applicable UK data protection laws. Personal data will not be sold to third parties, but may be shared with service providers such as payment processors or insurers where necessary to deliver the Services and manage the business.

13. Force Majeure

The Company will not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including but not limited to extreme weather, natural disasters, strikes, lockouts, accidents, transport disruptions, or compliance with legal requirements. In such cases, the Company’s obligations will be suspended for the duration of the event.

14. Variation of Terms

The Company reserves the right to amend these Terms and Conditions from time to time. The current version will apply to all bookings made after the revised Terms and Conditions are introduced. Customers are encouraged to review the Terms and Conditions periodically.

15. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court or other competent authority, that provision will be deemed severed and the remaining provisions will continue in full force and effect.

16. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or the Services provided by the Company, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, whether contractual or non-contractual.
